TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern the use of the Freshyzo mobile application and services provided by Freshyzo Foods Private Limited ("Freshyzo", "Company", "we", "our", or "us").
By registering, accessing, subscribing, purchasing, or using any Freshyzo service, you agree to be bound by these Terms.
1. ELIGIBILITY
By creating an account, you represent that all information provided by you is accurate, complete, and up to date.
2. SERVICES
Freshyzo provides doorstep delivery of fresh milk, dairy products, bakery items, daily essentials, and many other quality products. Our product range continues to grow to serve your everyday needs better.
Freshyzo reserves the right to add, modify, suspend, or discontinue any product or service without prior notice.
3. ACCOUNT REGISTRATION
Each account must be registered using a valid mobile number.
You are responsible for maintaining the confidentiality of your account credentials.
Freshyzo may suspend, restrict, or terminate accounts found to be:
Fraudulent
Duplicate
Misleading
In violation of these Terms
4. SUBSCRIPTION POLICY
Freshyzo operates primarily on a prepaid subscription model.
Supply of products shall commence only after successful payment and wallet recharge.
Customers must maintain sufficient wallet balance for uninterrupted service.
Freshyzo reserves the right to hold, pause, or discontinue deliveries where wallet balance becomes insufficient.
Delivery schedules may vary due to operational requirements, weather conditions, traffic conditions, public holidays, festivals, or circumstances beyond reasonable control.
Freshyzo does not guarantee fixed delivery times.
5. ORDER MODIFICATION, PAUSE & RESUME
Customers may request:
Quantity changes
Product changes
Delivery pause
Delivery resume
Requests must be submitted through the Freshyzo App or customer support before the applicable operational cut-off time.
Changes requested after cut-off time may be implemented from the following delivery cycle.
6. PRICING
Product prices are subject to change without prior notice due to:
Market fluctuations
Procurement costs
Transportation costs
Government taxes
Regulatory changes
Applicable prices displayed in the App shall prevail.
7. PAYMENTS & WALLET
Payments may be made through:
Payment Gateway
UPI
Net Banking
Debit Cards
Credit Cards
Other approved payment methods
Wallet balances are maintained solely for purchasing Freshyzo products and services.
Wallet balances:
Are non-transferable
Cannot be exchanged for cash
Do not earn interest
Cannot be sold or assigned
Freshyzo reserves the right to investigate suspicious transactions.
8. REFUND POLICY
All wallet recharges, subscriptions, trial purchases, promotional purchases, referral benefits, cashback credits, and offer-related payments are non-refundable except where required by applicable law.
Refund requests arising from customer misunderstanding of promotional eligibility shall not be entertained.
Where a customer becomes ineligible for a promotional offer, the amount paid may be utilized against Freshyzo products and services but shall not be refunded.
9. PROMOTIONAL OFFERS & TRIAL PLANS
Freshyzo may offer promotional campaigns including but not limited to:
Trial Plans
Introductory Offers
Cashback Offers
Recharge Benefits
Referral Programs
Discount Campaigns
Such offers may be changed, modified, suspended, extended, or withdrawn without prior notice.
Freshyzo reserves sole discretion regarding offer eligibility.
10. ONE HOUSEHOLD – ONE INTRODUCTORY OFFER
Introductory offers, including but not limited to trial plans such as "3+3 Days", are intended for first-time eligible households only.
Offer eligibility may be determined using:
Delivery Address
Mobile Number
Alternate Mobile Numbers
Customer Name
Device Information
Payment Information
Referral Activity
Historical Records
If multiple family members, residents, mobile numbers, SIM cards, or accounts from the same household attempt to claim the same introductory offer more than once, Freshyzo reserves the right to:
Reject the offer
Withdraw promotional benefits
Hold deliveries
Suspend accounts
Cancel promotional credits
In such cases:
Customers will only receive products equivalent to the amount actually paid.
Additional free products or promotional benefits shall not be granted.
No refund shall be issued.
Promotional benefits shall stand forfeited.
Freshyzo's determination regarding offer misuse shall be final and binding.
11. REFERRAL PROGRAM
Referral rewards are subject to successful completion of referral conditions.
Freshyzo may cancel, reverse, withhold, or recover referral benefits where:
Duplicate accounts exist
Self-referrals occur
Multiple registrations originate from the same household
Fraudulent activity is suspected
Freshyzo's decision regarding referral eligibility shall be final.
12. DELIVERY POLICY
Customers must ensure accurate delivery information.
Freshyzo shall not be liable for delivery failures resulting from:
Incorrect address information
Inaccessible premises
Security restrictions
Customer unavailability
Any complaint regarding delivery must be reported on the same day.
Complaints raised after the prescribed complaint period may not be entertained.
13. PRODUCT QUALITY COMPLAINTS
Customers must report product quality concerns within the same day of delivery.
Freshyzo reserves the right to inspect, verify, and investigate quality-related claims before providing any replacement, adjustment, or resolution.
14. CUSTOMER CONDUCT
Customers shall not:
Abuse customer support personnel
Threaten employees or delivery staff
Submit fraudulent complaints
Attempt to misuse promotional offers
Interfere with platform operations
Freshyzo reserves the right to suspend or terminate accounts engaging in such conduct.
15. COMMUNICATION CONSENT
By registering on the Freshyzo platform, you consent to receive:
Calls
SMS
WhatsApp Messages
Push Notifications
Email Communications
These communications may include service updates, delivery notifications, promotional offers, and account-related information.
16. SUSPENSION & TERMINATION
Freshyzo reserves the right to suspend, restrict, or terminate access to any account without prior notice where:
Fraud is suspected
Duplicate accounts are detected
Offer misuse is identified
Payment disputes arise
These Terms are violated
17. CHARGEBACKS & PAYMENT DISPUTES
If a customer initiates an unjustified chargeback, payment reversal, or payment dispute after receiving products or services, Freshyzo reserves the right to:
Suspend services
Recover outstanding amounts
Restrict account access
Pursue available legal remedies
18. FORCE MAJEURE
Freshyzo shall not be liable for delays or service interruptions caused by events beyond its reasonable control, including:
Natural disasters
Floods
Fires
Strikes
Government restrictions
Epidemics
Transportation disruptions
Technical failures
19. DISCLAIMER
Freshyzo provides services on an "as available" and "as is" basis.
While reasonable efforts are made to maintain uninterrupted service, Freshyzo does not guarantee that the App will always be available, error-free, secure, or uninterrupted.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Freshyzo's total liability arising from any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
21. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising from these Terms shall be subject exclusively to the jurisdiction of the competent courts located in Raipur, Chhattisgarh.
22. CHANGES TO TERMS
Freshyzo reserves the right to modify these Terms at any time.
Continued use of the App following any update shall constitute acceptance of the revised Terms.
